Letter to the Bacula Community concerning Bareos

Kern,

I find it quite funny your opinions on giving credit to authors of code
even when not strictly required by law, considering how Autodesk sort of
buried where all the second generation code for their/your products came
from.

Hello,

It sounds like you are questioning the logic of my convictions,
which is OK.  Perhaps you are doing so, but it would be best
to judge me based on when I had some say or control.  Concerning
Autodesk, I was never in the high management (my choice). I did
however work as a programming manager in Marin, California until
1989, and the only incident concerning accreditations was that
a documentation specialist had removed an accreditation that
I had put in the Lisp programming manual about the origin
of the software.  As soon as the guy complained (and I found
out) the citation was put back in.

After 1991, I was in Autodesk Europe, and so had no input
to the parent company, and it was that year that the management
changed from being the founders to Carol Bartz.  I cannot tell
you what happened in Autodesk after 1993 since I went on
long term sick leave in 1993 never to return to work.   If they
have hidden something, it is too bad.  On the other hand, Autodesk
being a commercial company, like all other commercial companies
does not have much interest in publishing where products come
from and the source is not open.  It is a pity, but that is a much bigger
problem than what I am dealing with today.

I converted to open source in 1998 so I would hope that it is the
period after that when one should judge what I have done
concerning open source and open development.

I am sorry, I have no idea what Drafix is.  If you meet me, I
would be interested to hear your story.

Concerning your offer of help: for the moment, I think we just have
to wait and hope that the lawsuit calms most of the undesirable
consequences of the behavior they have consistently shown over the

Yes, theft of code is serious, and the lawsuit shows that
Bacula Systems takes it seriously. However the response
of Mr. Aussendorf, posted to LinkedIn, after he received
a copy of the complaint:

"Yes, we've received it. It's very big sophisticated FUD but still
FUD. We are currently preparing an answer."

doesn't sound to me like he is taking it too seriously.

In addition to the theft reported by Bacula Systems, there is the
problem of plagiarism that I mentioned in my letter to the
community. The main Bareos developer continues to move files
from one location to another while making some changes, but
also stripping the copyright and the accreditations and adding
the Bareos copyright. This is continuing even as of a few days
ago.

This is probably another form of theft but is I think more
properly called plagiarism and copyright violations. I believe it
to be bad for open source as well as for Bareos' image.
Unfortunately, for the moment, I don't know how to stop it
other than posting publicly.

   It is very sad indeed to hear that you have to deal with all this and I can't even imagine what it must feel like to have someone work with you and then do something like this. I know nothing has been proven in the court etc, but I know what kind of dedication you have to Bacula and how much personal time and effort you put into this.
  I count myself as one of the "silent" supporters of Bacula whereby I do not participate much in lists and contribute no code, but I just want to express my gratitude to you for all you have done to create such a great project and also express you support in what you are going through with this situation with Bareos.

Hello Paul,

Thank you for your kind words; they mean much more to me than
you might imagine.

I for one use lots of open source, but find time to contribute to Bacula,
so I understand that not everyone contribute.  Besides for me the
greatest part
of Bacula is knowing that lots of people use it and like it.

This has been very hard on me especially the (alleged) stolen code part.
Had I known that this would happen in the beginning, I would probably
have contributed my time to some local charity (well I have done that but
could have done a lot more).

That said, I am determined to continue and do the best that I can
for Bacula.
